1. Introduction and Acceptance of Terms
Welcome to the Maracaibo community website. We encourage all Members to use this website to build relationships, share ideas, and contribute positively to life at Maracaibo.
For the purposes of these Terms of Use, “Maracaibo” means Maracaibo Estates Ltd. and Strata Corporation 905, and “we", "us" or "our" means Maracaibo Estates Ltd. and Strata Corporation 905.
This website is operated by Maracaibo located in British Columbia, Canada, and is maintained as a resource for the benefit of Members.
By accessing or using this website, you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, please do not access or use the website.
These Terms constitute an agreement between you and Maracaibo. We reserve the right to update these Terms at any time and Members will be notified of material changes. Your continued use of the website following such notice signifies acceptance of the revised Terms.
2. Who May Use This Website
Access to publicly accessible pages is available to any website visitor.  Access to member-only areas is limited to current Members and authorised staff of Maracaibo, where Member is defined as those persons having membership privileges of Maracaibo as described in Maracaibo Estates Policies section 3.1 with the exception of Temporary Members.
3. Permitted Uses
This website is here to help community communication, coordination, and share information. You may use it to:

  • Find out more about living at Maracaibo
  • Read community announcements, newsletters
  • Look up Maracaibo documents, such as notices, policies, by-laws, rules, and meeting minutes
  • Register for community events and book shared amenities
  • View the Member directory, in line with other Members’ privacy preferences 
  • Take part in community forums and discussion boards.

4. Member-Submitted Content
The website is an extension of our community, and Member contributions help to make it a useful and lively place for everyone. 
Members may submit content to the website, such as forum posts, blogs, comments, photos, and event listings (“Member Content”). By submitting Member Content, you confirm that:

  • You own the Member Content or have the necessary rights to submit it;
  • The content does not violate any applicable law, these Terms, or or Maracaibo’s bylaws, rules, and policies; and
  • You abide by our community guidelines or standards for posting of website content.

You always retain ownership of your Member Content. By submitting it, you grant Maracaibo a non-exclusive, royalty-free licence to display, reproduce, and distribute that content on the website for Maracaibo purposes. This licence continues for as long as the content remains on the website.
You may ask that your Member Content be removed by contacting the website administrator. Maracaibo will consider each request and, where practicable, will remove the content within a reasonable time. In some cases, content may need to remain available, for example where it forms part of a record that Maracaibo is required to retain under applicable law or its bylaws, or where its removal would significantly affect another Member’s rights.
Where Maracaibo declines a removal request, you will be informed of the reason in writing within a reasonable time.
Maracaibo may remove, edit, or restrict access to Member Content that appears to violate these Terms, applicable by-laws, policies, or community guidelines or standards. Where practicable, Maracaibo will notify the submitting Member before removing content. A Member whose content has been removed or restricted may seek a review under Section 10.
5. Member Responsibilities
Members are responsible for maintaining the confidentiality of their login credentials and for all activity conducted through their accounts. Please notify the website administrator promptly if you become aware of any unauthorised access or suspicious activity. Maracaibo will suspend or revoke access where an individual ceases to be a Member, or where the website’s security is at risk.
To keep the website secure and functioning properly, you must not:

  • Attempt to gain unauthorised access to restricted areas of the website or to another Member’s account;
  • Upload or transmit malware, including malicious software, viruses, or harmful code;
  • Do anything that disrupts or interferes with the proper functioning of the website;
  • Systematically scrape, harvest, or otherwise misuse any data from the website; or
  • Infringe the intellectual property rights of Maracaibo or any third party.

To support a respectful and lawful community environment, you also must not:

  • Post content that is defamatory, harassing, threatening, abusive, or discriminatory toward any person;
  • Disclose or share another Member’s personal information without their express consent;
  • Use the website for advertising or commercial solicitation without prior approval from the Board and Strata Council; or
  • Impersonate another Member, Board and Council member, or any other person.

Violations may result in suspension or termination of member-site access and referral to the Board and Strata Council for action under Maracaibo by-laws and policies. 
6. Intellectual Property
Unless otherwise noted, all content on this website produced by or on behalf of Maracaibo, including the website design, logos, documents, newsletters, and communications, is the property of Maracaibo, or its licensors. Members may access and use this content for personal, non-commercial community purposes only.
You may not reproduce, distribute, modify, or create derivative works from any content without prior written permission from the Board and Strata Council.
7. Third-Party Links and Services
This website may contain links to third-party websites or integrate third-party services (such as website platform provider, payment processors, booking services, or mapping tools) for Members’ convenience. These services are governed by their own terms and policies. Maracaibo is not responsible for the content or practices of any third-party website or service, and the inclusion of a link does not constitute an endorsement.
8. Disclaimers and Limitation of Liability
This website and its contents are provided on an as-is and as-available basis. While we make reasonable efforts to keep information current and accurate, Maracaibo makes no warranties, express or implied, regarding the accuracy, completeness, or reliability of any content on the website.
To the fullest extent permitted under the laws of British Columbia and Canada, Maracaibo, its Board of Directors and Council members, employees, contractors, and volunteers shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of or inability to use this website, including errors or omissions in content, unauthorised access, or loss of data.
9. Website Availability and Changes
Maracaibo may modify, suspend, or discontinue any aspect of this website at any time, including the availability of features, databases, or content. We may also restrict access to parts of the website without notice or liability.
Reasonable efforts will be made to provide advance notice of planned maintenance or significant changes, but uninterrupted access to the website cannot be guaranteed.
10. Member Rights and Recourse
If you feel that Maracaibo has unfairly suspended your access, removed your content, or made a decision that significantly affects your use of the website, you have the right to appeal.
To appeal, send a written request to the Board and Strata Council within 30 days of the decision or action, explaining why you think it was made in error. The Board and Strata Council will review your request according to Maracaibo's by-laws and policies, and will respond in writing within 30 days. They may also ask for more information or invite you to a meeting.
For privacy-related concerns, contact the Privacy Officer (see the Privacy Policy), or file a complaint with the Office of the Information and Privacy Commissioner for BC at www.oipc.bc.ca.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of the Province of British Columbia and Canada as applicable. 
If you have a dispute related to these Terms or the website, you must first go through the internal review process described in Section 10. If the dispute isn't resolved that way, either party may pursue voluntary mediation through a recognised mediation service in British Columbia before starting legal proceedings. 
If mediation doesn't resolve the dispute, it will be subject to the exclusive jurisdiction of the courts of British Columbia.
