For the purposes of these Terms of Use, “Maracaibo” means Maracaibo Estates Ltd. and Strata Corporation 905, and “we", "us" or "our" means Maracaibo Estates Ltd. and Strata Corporation 905.
This website is operated by Maracaibo located in British Columbia, Canada, and is maintained as a resource for the benefit of Members.
By accessing or using this website, you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, please do not access or use the website.
These Terms constitute an agreement between you and Maracaibo. We reserve the right to update these Terms at any time and Members will be notified of material changes. Your continued use of the website following such notice signifies acceptance of the revised Terms.

Access to publicly accessible pages is available to any website visitor. Access to member-only areas is limited to current Members and authorised staff of Maracaibo, where Member is defined as those persons having membership privileges of Maracaibo as described in Maracaibo Estates Policies section 3.1 with the exception of Temporary Members.

The website is an extension of our community, and Member contributions help to make it a useful and lively place for everyone.
Members may submit content to the website, such as forum posts, blogs, comments, photos, and event listings (“Member Content”). By submitting Member Content, you confirm that:
You always retain ownership of your Member Content. By submitting it, you grant Maracaibo a non-exclusive, royalty-free licence to display, reproduce, and distribute that content on the website for Maracaibo purposes. This licence continues for as long as the content remains on the website.
You may ask that your Member Content be removed by contacting the website administrator. Maracaibo will consider each request and, where practicable, will remove the content within a reasonable time. In some cases, content may need to remain available, for example where it forms part of a record that Maracaibo is required to retain under applicable law or its bylaws, or where its removal would significantly affect another Member’s rights.

Members are responsible for maintaining the confidentiality of their login credentials and for all activity conducted through their accounts. Please notify the website administrator promptly if you become aware of any unauthorised access or suspicious activity. Maracaibo will suspend or revoke access where an individual ceases to be a Member, or where the website’s security is at risk.

10. Member Rights and Recourse
If you feel that Maracaibo has unfairly suspended your access, removed your content, or made a decision that significantly affects your use of the website, you have the right to appeal.
To appeal, send a written request to the Board and Strata Council within 30 days of the decision or action, explaining why you think it was made in error. The Board and Strata Council will review your request according to Maracaibo's by-laws and policies, and will respond in writing within 30 days. They may also ask for more information or invite you to a meeting.

11. Governing Law and Jurisdiction
These Terms are governed by the laws of the Province of British Columbia and Canada as applicable.
If you have a dispute related to these Terms or the website, you must first go through the internal review process described in Section 10. If the dispute isn't resolved that way, either party may pursue voluntary mediation through a recognised mediation service in British Columbia before starting legal proceedings.
If mediation doesn't resolve the dispute, it will be subject to the exclusive jurisdiction of the courts of British Columbia.
